A Campbells Creek woman who pleaded guilty to a 2022 arson was ordered Tuesday to pay $27,000 in restitution for the demolition and lost income from the MacCorkle Avenue home she burned down.
Patricia K. White, 50, pleaded guilty to voluntary manslaughter and second-degree arson last summer.
Dennis Rutledge, 52, died in the fire White set at 5213 MacCorkle Avenue in Kanawha City in January 2022. Attorneys have said White didn’t know Rutledge was in the house. Police said an altercation between White and her husband led to the incident. At Tuesday's hearing, White's attorney, Joseph Spano, said that White was severely mentally ill at the time.
Assistant prosecuting attorney Ken Bannon asked for the restitution to cover the cost of demolition — quoted between $18,000 and $24,000 — and two years of lost rent at $750 a month.
Kaye Risk, sister-in-law of the property owner, testified Tuesday that the house was not being rented out at the time of the fire and that it had been damaged by “vagrants.â€
The house was purchased to create an income stream for the property owner who is mentally challenged, Risk said.
White, who was sentenced to eight years with 600 days credited to the sentence, testified that she has no savings and no meaningful way to create income while in jail.
She is taking continuing education classes but has no specific plans for work yet. She has to care for her sick father as well.
Bannon said White will be required to work as a condition of parole, whenever that is granted. According to online prison records, White will be eligible for parole next February.
Kanawha County Circuit Court Judge Dave Hardy ordered that White pay $18,000 to cover the lowest quote for the demolition and $9,000 to cover one year’s rent.
