This spring, the Kanawha County Grand Jury indicted a man for negligent homicide, a misdemeanor offense.
According to the indictment, Brandon Scott Turley-Ward “did unlawfully drive and operate a motor vehicle in reckless disregard of the safety of others†and caused the death of Carl Wiley. The offense occurred “on or about†May 10, according to the indictment, which doesn’t give an exact location of the homicide.
ÂÒÂ×ÄÚÉä police officers investigated the incident, but neither the police nor the Prosecuting Attorney’s office can release the report, as the case is ongoing.
Turley-Ward, who was not arrested for the crime, pleaded not guilty to the charge Thursday morning. Circuit Court Judge Dave Hardy gave Turley-Ward until Monday to pay bail through a $2,500 property bond or $250 cash.
Turley-Ward does not have any felony convictions, his attorney Philip Sword said in court.
A trial date has been set for Dec. 9.
Negligent homicide is a misdemeanor offense with a penalty of not more than a year in prison and/or a fine between $100 and $1,000. The driver’s license of the convicted person is also revoked.
This offense makes eight reported homicides in ÂÒÂ×ÄÚÉä this year.
